Types of Determinations

The Tribunal is required to make annual determinations on remuneration payable to the groups listed below.

 Annual Determinations

The Tribunal is required to make annual determinations on remuneration payable to the groups listed below.

  • Public Service Senior Executives (PSSE)
  • Chief and Senior Executive Service (SES) - as required under the provisions in the Government Sector Employment Act 2013 (GSE Act) that allow for a three year implementation period for the SES to transition to the new PSSE structure
  • Judges and Magistrates Group
  • Court Related Officers Group
  • Public Office Holders Group
  • Governor of New South Wales

With the exception of those positions listed in the Statutory and Other Offices Remuneration Act 1975,or other relevant legislation, the Tribunal does not determine remuneration for part time members of NSW Government Boards and Committees.

Remuneration for part time members of boards and committees is determined in accordance with the Public Service Commission Directive - Classification and Remuneration Framework for NSW Government Boards and Committees. For further information go to NSW Government Boards and Committees.

Special Determinations

The Tribunal may also make special determinations on issues referred by the Premier or Special Minister of State, Minister for Roads, Minister for the Arts, Minister for Music and the Night-time Economy, and Minister for Jobs and Tourism.

Compensation Determinations

The Tribunal is also required to determine compensation claims for certain categories of senior executives. Further information is available at Compensation Applications.

Effective Date of Determinations

Annual determinations take effect from 1 July each year. Note: Annual determinations made prior to 1 July 2014 took effect from 1 October)

The annual determination for the Governor of New South Wales takes effect from the anniversary of appointment.

Special determinations take effect from the date specified in the determination.

Publication of Determinations

The Tribunal's report and determination are tabled in the Parliament and published in the NSW Government Gazette.
